Terms & Conditions

Whited & Co, LLC Effective Date: 01/07/2026 State of Maine

1. About Whited & Co, LLC

Whited & Co, LLC ("Provider," "we," "us," or "our") is a licensed limited liability company operating in the State of Maine, providing residential handyman and home maintenance services to homeowners ("Customer," "you," or "your") within Cumberland County, Maine. These Terms and Conditions govern all services provided by Whited & Co, LLC, including one-time project work and all Home Care Plan subscriptions. By engaging Whited & Co, LLC for any service or purchasing any plan, the Customer agrees to these Terms and Conditions in full.

2. Services Offered

Whited & Co, LLC provides residential handyman services including but not limited to general home repairs, furniture assembly, door and window repair, minor plumbing fixtures, minor electrical (handyman-level), painting and finishing, flooring repair, carpentry, exterior maintenance, and scheduled home maintenance visits under our Home Care Plans. Whited & Co, LLC operates as a solo operator. All work is performed directly by the owner. Whited & Co, LLC does not currently employ subcontractors. Any change to this structure will be communicated to active plan holders in advance.

3. Service Area

Services are provided exclusively within Cumberland County, Maine. Requests for service outside this area will be evaluated on a case-by-case basis and may be subject to an additional travel fee, which will be communicated to the Customer prior to scheduling. Whited & Co, LLC reserves the right to decline any service request outside its standard service area without obligation.

4. Home Care Plans

Whited & Co, LLC offers three annual Home Care Plans. All plans are annual subscriptions only, paid in full at enrollment. No monthly payment option is available. Each plan includes scheduled two-hour maintenance visits consisting of a whole-home inspection and minor labor repairs. Materials are excluded from all plans and billed separately. The three available plans are as follows:

4.1 Basic Home Care Plan — $800/year Two (2) scheduled visits per year, recommended in Spring (April–June) and Fall (September–October). Includes a 5% discount on additional project work booked directly with Whited & Co, LLC.

4.2 Essential Home Care Plan — $1400/year Four (4) scheduled visits per year, recommended seasonally in Spring (April–June), Summer (July–August), Fall (September–October), and Winter (November–December). Includes a 10% discount on additional project work booked directly with Whited & Co, LLC.

4.3 Premium Home Care Plan — $2,000/year Six (6) scheduled visits per year, spaced approximately every two months. Includes priority and emergency scheduling privileges and a 15% discount on additional project work booked directly with Whited & Co, LLC. Priority scheduling does not guarantee same-day service. Emergency visits are billed separately at the standard hourly rate of $100 per hour.

5. Visit Terms

5.1 Duration All Home Care Plan visits are capped at two (2) hours per visit. This includes time for the walkthrough inspection and any minor repairs completed during the visit. Any work that cannot be completed within the two-hour window will be quoted separately as a standalone project at the standard hourly rate of $100 per hour.

5.2 Minor Repairs Defined Minor repairs are defined as tasks that can be reasonably completed within the allotted visit time using basic materials, requiring no return visit, no specialized licensing, and no permit. Examples include tightening hardware, replacing HVAC filters, re-caulking, adjusting doors, replacing outlet covers, inspecting weatherstripping, and similar small-scale tasks.

5.3 Scheduling Visits must be scheduled in advance. The Customer is responsible for scheduling their visits within the plan year. Unused visits do not roll over and are forfeited at the end of the plan year. Whited & Co, LLC will make reasonable efforts to send scheduling reminders at the start of each recommended seasonal window.

5.4 Rescheduling and Cancellations Customers may reschedule with a minimum of 48 hours notice at no charge. Cancellations with less than 24 hours notice may result in forfeiture of that visit at the Provider's discretion. Whited & Co, LLC reserves the right to reschedule due to severe weather, unsafe road conditions, illness, or other circumstances beyond its control, including conditions common to Maine winters. Advance notice will be provided whenever possible.

5.5 Visit Summary Following each visit, Whited & Co, LLC will provide the Customer with an itemized visit summary documenting work completed, materials used, items flagged for future attention, and photographs of any noted concerns.

6. Scope Exclusions

The following are excluded from all Home Care Plan visits and will be quoted separately as standalone project work:

  • Any work that cannot be completed within the two-hour visit window

  • Work requiring Maine state-issued licenses, including licensed electricians (Maine Electricians' Examining Board), licensed plumbers (Maine Plumbers' Examining Board), or licensed HVAC technicians

  • Structural repairs of any kind

  • Roof repairs requiring roof access

  • Any project requiring municipal or state permits under Maine building codes

  • Pest control or remediation, including carpenter ant and termite treatment

  • Mold or moisture remediation

  • Appliance repair or replacement

  • Chimney cleaning, inspection, or repair

  • Oil, propane, or wood heating system service or repair

  • Landscaping or lawn care

  • Dock, float, or waterfront structure repair

  • Any work deemed outside safe or reasonable handyman scope under Maine law
     

7. One-Time Project Work

Whited & Co, LLC accepts one-time project requests outside of Home Care Plans. One-time work is billed at a standard rate of $100 per hour. A written estimate will be provided prior to commencement of any project exceeding one hour of anticipated labor. Estimates are based on anticipated scope and are subject to adjustment if the scope of work changes. Materials for all project work are billed separately at cost plus a 10% sourcing and handling fee. Maine sales tax applies to all materials where required under Maine Revenue Services regulations.

8. Payment Terms

8.1 Accepted Payment Methods Whited & Co, LLC accepts payment by credit or debit card, cash, PayPal, and personal or business check.

8.2 Home Care Plan Payment All Home Care Plans are paid in full at the time of enrollment. The plan period begins on the date of payment and runs for 12 months.

8.3 Project Work Payment Payment for one-time project work is due upon completion of the work unless a separate written payment arrangement has been agreed upon in advance. For larger projects, Whited & Co, LLC reserves the right to require a deposit of up to 50% prior to commencement of work.

8.4 Returned Checks Returned checks will be subject to a $35 returned check fee. Repeated returned checks may result in cash-only payment requirements for future work.

8.5 Late Payments Invoices unpaid after 30 days will be subject to a 1.5% monthly late fee. Whited & Co, LLC reserves the right to suspend services for accounts with outstanding balances.

9. Materials

All materials required to complete any work — whether under a Home Care Plan or one-time project — are billed separately and are not included in any labor rate or plan price. Materials are billed at cost plus a 10% sourcing and handling fee. An itemized receipt or line item will be provided for all materials. The Customer will be informed of anticipated material costs before purchase whenever practical. Maine sales tax will be applied to all materials where applicable.

10. Cancellation and Refund Policy

10.1 Home Care Plan Cancellation — Customer Initiated Customers may cancel their Home Care Plan within 3 business days of enrollment for a full refund in accordance with Maine's right of rescission principles. After 3 business days, refunds will be prorated based on visits used. A $25 administrative fee will be deducted from all prorated refunds. Per-visit values for proration purposes are as follows: Basic Plan $150 per visit, Essential Plan $187.50 per visit, Premium Plan $333.33 per visit.

10.2 Home Care Plan Cancellation — Provider Initiated Whited & Co, LLC reserves the right to cancel any Home Care Plan with 30 days written notice and a prorated refund for unused visits. Whited & Co, LLC may cancel immediately and without refund in cases of Customer harassment, unsafe property conditions, or material breach of these Terms and Conditions.

10.3 Project Work Cancellation For one-time project work, cancellations made with less than 24 hours notice may result in a cancellation fee equal to one hour of labor at the standard rate of $100. Deposits paid for larger projects are non-refundable if work has already commenced.

11. Insurance and Liability

11.1 Insurance Whited & Co, LLC maintains general liability insurance. Proof of insurance is available upon request. Whited & Co, LLC does not currently carry workers compensation insurance as it operates as a solo operator with no employees. This will be updated if the business structure changes.

11.2 Limitation of Liability Whited & Co, LLC's total liability for any claim arising from services performed shall not exceed the total amount paid by the Customer for the work in question. For Home Care Plan Customers, liability shall not exceed the total annual plan price paid. Whited & Co, LLC is not liable for pre-existing conditions, hidden defects, consequential damages, or damage resulting from deferred maintenance that was identified but not yet repaired.

11.3 Property Access The Customer agrees to provide Whited & Co, LLC safe and reasonable access to all areas of the home required to perform the agreed work. Whited & Co, LLC is not responsible for any areas that were inaccessible during a scheduled visit.

11.4 Lead Paint and Hazardous Materials For homes built before 1978, the Customer acknowledges the possible presence of lead paint. Whited & Co, LLC will follow applicable EPA RRP (Renovation, Repair, and Painting) guidelines where required by law. Whited & Co, LLC is not responsible for the testing, identification, or remediation of any hazardous materials including but not limited to asbestos, lead paint, or oil contamination.

11.5 Pre-Existing Conditions Whited & Co, LLC will make reasonable efforts to identify and communicate pre-existing damage or deficiencies observed during any visit or project. The Provider is not responsible for damage or failures arising from pre-existing conditions that were present prior to service.

12. Customer Responsibilities

The Customer agrees to:

  • Provide safe, clean, and accessible working conditions for all scheduled visits and project work

  • Disclose any known hazardous materials, structural concerns, or safety issues prior to commencement of work

  • Ensure a responsible adult aged 18 or older is present during all service visits

  • Provide accurate information about the property and the scope of work requested

  • Make payment in accordance with the terms outlined in Section 8
     

13. Maine Consumer Protection

This agreement is subject to the Maine Unfair Trade Practices Act (5 M.R.S. §§ 205-A through 214) and all applicable Maine consumer protection regulations. Where applicable, services involving home construction or improvement are subject to Maine's Home Construction Contract Act (10 M.R.S. §§ 1486–1490). Nothing in these Terms and Conditions limits or waives the Customer's rights under Maine law.

14. Dispute Resolution

14.1 Good Faith Resolution In the event of a dispute arising from services provided by Whited & Co, LLC, both parties agree to first attempt resolution in good faith through direct communication before pursuing any formal legal action.

14.2 Governing Law and Venue This agreement shall be governed exclusively by the laws of the State of Maine. Any legal action arising from this agreement shall be filed in the appropriate Maine state court in Cumberland County.

14.3 Attorney's Fees Each party shall bear their own attorney's fees in any dispute arising from this agreement unless otherwise ordered by a Maine court of competent jurisdiction.

15. Modifications to Terms

Whited & Co, LLC reserves the right to update or modify these Terms and Conditions at any time. Active Home Care Plan holders will be notified of any material changes with a minimum of 30 days written notice. Continued use of services following notification constitutes acceptance of the updated terms. The most current version of these Terms and Conditions will always be available on the Whited & Co, LLC website.

16. Entire Agreement

These Terms and Conditions constitute the entire agreement between Whited & Co, LLC and the Customer with respect to all services provided. They supersede any prior verbal or written communications, representations, or agreements. Any modifications to these terms must be made in writing and signed by both parties to be enforceable.

Acknowledgment

By engaging Whited & Co, LLC for any service or purchasing any Home Care Plan, the Customer acknowledges that they have read, understood, and agreed to these Terms and Conditions in full.
